Terms and Conditions

1. Introduction

These Terms and Conditions govern the relationship betweenChef Jobs Ireland LTD (the "Agency") and the client/candidate (the "Client/Candidate"). By using the Agency's services, the Client/Candidate agrees to be bound by these terms.

2. Services

The Agency provides recruitment services to assist Clients in finding suitable candidates for employment and to assist Candidates in finding suitable employment opportunities. This includes:

  • Permanent Staffing:
    • Job posting and advertising
    • Candidate sourcing and screening
    • Interview coordination
    • Reference checking
    • Offer negotiation
    • Onboarding support
  • Temporary Staffing:
    • Job analysis and specification
    • Candidate selection and matching
    • Temporary employment contract negotiation
    • Payroll processing and administration
    • Worker safety and compliance

3. Client Obligations

  • Provide accurate and complete job descriptions, including salary range, benefits, and requirements.
  • Cooperate with the Agency in the recruitment process.
  • Pay the Agency's agreed-upon fees and expenses.
  • Comply with all applicable laws and regulations, including employment laws, health and safety regulations, and temporary staffing regulations.

4. Candidate Obligations

  • Provide accurate and complete information on applications and resumes.
  • Cooperate with the Agency in the recruitment process.
  • Comply with all applicable laws and regulations, including employment laws and health and safety regulations.
  • Adhere to any agreements or contracts signed with the Agency or Clients.

5. Agency Obligations

  • Exercise reasonable care and skill in providing its services.
  • Maintain confidentiality of Client and Candidate information.
  • Comply with all applicable laws and regulations.
  • Provide support and assistance to Clients and Candidates throughout the recruitment process.
  • For temporary staffing, ensure that temporary workers are properly classified and paid in accordance with applicable labor laws.

6. Fees and Expenses

  • The Agency's fees and expenses will be as agreed upon in writing with the Client.
  • Fees may be based on a percentage of the candidate's starting salary or a fixed fee.
  • Expenses may include advertising costs, background checks, and travel expenses.
  • For temporary staffing, fees may be based on an hourly rate or a percentage of the temporary worker's wages.

7. Insurance and Health and Safety

  • The Agency will maintain appropriate insurance coverage to protect itself and its clients.
  • The Agency will ensure that all its employees and contractors comply with health and safety regulations.
  • Clients and Candidates are responsible for their own insurance coverage and compliance with health and safety regulations.

8. Equipment and Facilities

  • The Agency will provide necessary equipment and facilities for its operations.
  • Clients and Candidates may be required to provide their own equipment or use the Agency's equipment, as agreed upon.

9. Termination

  • Either party may terminate the agreement for any reason with reasonable notice.
  • Upon termination, the Agency will provide the Client/Candidate with any outstanding information or documents.

10. Governing Law

  • These Terms and Conditions shall be governed by the laws of [Jurisdiction].

11. Dispute Resolution

  • Any disputes arising from these Terms and Conditions shall be resolved through negotiation or mediation. If unable to resolve the dispute through these means, the parties agree to submit to binding arbitration.

12. Entire Agreement

  • These Terms and Conditions constitute the entire agreement between the parties and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.   

By using the Agency's services, the Client/Candidate acknowledges and agrees to these Terms and Conditions.
